About the role
- Provide assistance to support lawyers in various stages of the litigation process with respect to the prosecution, defence and resolution of lawsuits.
- Prepare draft pleadings, motion records, documentary discovery involving issues of facts and law, legal research and assistance in preparing cases for trial, arbitration, or other hearings.
- Develop and review appropriate legal strategy for discovery, investigation, handling and trial/hearing of cases or matters; advise, communicate and develop strategies with TD Insurance Claims Representatives and Insured Clients as appropriate.
- Prepare draft legal documents, correspondence, pleadings, motions, mediation and pre-trial/arbitration memorandums including those requiring legal research.
- Attend with lawyer and/or summarize discoveries when necessary.
- Review both the Claims records and legal files to respond to discovery demands and obtain answers to undertakings and other file documentation.
- Update/post in electronic system all relevant work completed on a file.
- Prepare document briefs.
- Attend settlement conferences with Claims approval and under supervision of lawyer assist in the settlement of cases.
- May assist in handling investigations including locating witnesses, interviewing witnesses and obtaining evidence for trial.
- Assist lawyers in mediation, pre-trial, trial and arbitration preparation.
- May attend court conferences and pre-trial/arbitration hearings in conjunction with a lawyer.
- May assist lawyers at trial/arbitration.
- May attend court on uncontested and consent motions and simple contested motions (according to local court/provincial jurisdictions).
Requirements
- A law degree with LLB or J.D. from a recognized law school.
- Qualified to commence articling in August, 2026 in accordance with the requirements of the Law Society of Ontario, for a period of ten (10) months.
- General knowledge of procedural and substantive law (insurance law an asset), basic knowledge of court procedures and basic understanding of the operations and requirements of insured clients and insurers.
- Strong oral communication skills, with a willingness to appear in court.
- Previous court, mock trial, mooting and/or legal clinic experience is an asset.
- Excellent writing skills and the ability to draft clear, concise and persuasive memoranda, pleadings, opinions and other legal documents.
- Able to communicate effectively and professionally with policyholders, counsel, Judges, Masters, court personnel and professionals within the legal industry.
- Able to work productively and efficiently under pressure.
- Excellent interpersonal skills with a demonstrated ability to work both independently and collaboratively with others.
- Superior organizational skills with a strong work ethic and ability to multi-task.
- Able to perform complex legal research, writing and analysis.
