About the role

  • Responsible for providing legal counsel and representation of the Department in all phases of the acquisition of right-of-way for transportation facilities.
  • Responsible for representation in all phases of eminent domain proceedings, including research, the preparation of pleadings, discovery, preparation of witnesses, hearings, settlement negotiations, and trial.
  • Responsible for preparing real estate conveyance documents.
  • Responsible for representation in defense of the Department in claims of inverse condemnation, as assigned.
  • Responsible for thoroughly researching all state and federal statutes, court cases, rules, and regulations affecting the right-of-way acquisition operations of the Department.
  • Responsible for advising the right-of-way offices the attorney is assigned to work with of their legal powers and duties, how the law affects their operations, and the implementation of policies and rules.
  • Provides support to Department attorneys representing the Department in claims and litigation against and by the Department.
  • Assists with responding to public records requests and subpoenas, as assigned.

Requirements

  • Must be a member of The Florida Bar
  • Knowledge of Litigation and civil rules of procedure and practice and Government In the Sunshine Law
  • The principles and techniques of effective verbal and written communications
  • Ability to understand and apply applicable rules, regulations, policies, and procedures
  • Utilize problem solving techniques
  • Work independently
  • Plan, organize, and coordinate work assignments
  • Communicate effectively orally and in writing
  • Establish and maintain effective working relationships with others
  • Use word processing, graphic presentation software, database, and mainframe applications.
